Privacy Policy & Statement

VFL Finance Group (referred to as “we”, “us”, or “our”)

We are committed to protecting your privacy. This statement explains how we collect, use, store, and share your personal information in line with the New Zealand Privacy Act 2020 and the Land Transport Act 1998 and Section 241 of the NZ Land Transport Act 1998.

This Policy/Statement outlines how VFL Limited and its related entities collect, disclose, use, store, or otherwise handle Personal Information. These entities include:

  • Flexi Lease NZ Limited
  • VFL Securities Limited
  • VFL Limited

In this Policy/Statement, these entities are collectively referred to as the VFL Entities, VFL, we, us, or our. “Related Companies” has the meaning set out in the Companies Act 1993.

This Policy is effective as at 17th August 2026. Sometimes we will update it. You can always find the current version on our website.

This Policy/Statement explains:

  • The kinds of Personal Information we collect and why we do it.
  • How we manage Personal Information once we collect it.
  • How you can access, correct, or delete your Personal Information.
  • How you can make a complaint about our handling of your Personal Information.

This Policy/Statement applies to our customers, guarantors, employees, contractors, and any other individuals who contact us about our products or services. This includes credit accounts, vehicle sales, machinery leasing, or goods leasing. Not all parts of this Policy/Statement may apply to you.

What is Personal Information?

“Personal Information” means information about an identifiable individual as defined in the Privacy Act (for example, your name and date of birth).

It also includes:

  • Credit Information: Your payment history, credit scores, and amount of credit extended, as defined in the Credit Reporting Privacy Code.
  • Motor Vehicle Register (MVR) Data: Your personal details recorded on the official New Zealand Motor Vehicle Register.
  1. What Personal Information We Collect

When you apply for credit, products, or services, we collect personal information from you. This includes:

  • Contact Details: Full name, date of birth, physical addresses, telephone numbers, and email address.
  • Identity Documents: Passport and driver’s licence documents for electronic verification.
  • Financial Background: Credit records, loan details, banking history, employment, and financial information.
  • Motor Vehicle Records: Registered person names, addresses, and vehicle details linked to motor vehicles.  
  1. How and Why We Collect Your Information
  • We collect data directly from you when you interact with us or fill out an application.
  • To comply with Information Privacy Principle 3A (IPP 3A), we also notify you that we collect your information indirectly from third parties. We do this to assess your application, confirm details, and check security assets.
  • We collect and use your data for the following specific purposes:
  • Identity Verification: To confirm who you are and meet our legal Anti-Money Laundering (AML) compliance obligations.
  • Credit Assessments: To check your financial history and judge your application to obtain finance from us.
  • Account Management: To manage your account(s), update credit reporting files, and pursue arrears or overdue money.
  • Legal Requirements: To comply with any other use, obligation, or requirement of New Zealand law.
  1. Motor Vehicle Register (MVR) Access Under Section 241
  • Our company is authorised by Waka Kotahi NZ Transport Agency (NZTA) under Section 241 of the Land Transport Act 1998 to access personal information held on the Motor Vehicle Register.
  • Official Authorisation: We pull names and addresses directly under the official New Zealand government Gazette Notice 2022-au4072.
  • Our Specified Purpose: We only look up register details to verify ownership information, process finance applications, manage active vehicle loans, or handle vehicle repossessions. [
  • Your Right to Opt-Out: Any person can notify the Registrar of Motor Vehicles that they do not want their name and address shared under an authorisation. You can choose to opt out directly through the NZTA MVR Access Information Page.
  • Exceptions to Opting Out: If you opt out, we may still legally access your information under other sections of the law (such as Section 237 of the Land Transport Act 1998) if needed for legitimate debt recovery or enforcement.
  • Secure Deletion: Any personal data pulled from the MVR is safely stored and destroyed as soon as the authorised business purpose is finished.
  1. Who We Share Your Information With
  • Besides our staff, the third parties we share this information with include:
  • Credit Reporting Agencies: We share details with Centrix (PO Box 62-512, Greenlane Auckland) and Equifax (Private Bag 912012, Auckland) to assess loans, monitor active accounts, and record defaults.
  • Government Departments: The Ministry of Justice (to check for court fines), NZTA (for driver licence checks), Department of Internal Affairs (for identity matching), the Motor Vehicle Register, and the Personal Property Securities Register (PPSR).
  • Verification Partners: Third-party electronic ID check providers that run compliance checks on our behalf.
  • Financial & Legal Support: Debt collection agencies, legal professionals, and anyone who acts as a guarantor for your money.
  • Our Group: Other business entities within the VFL Finance Group of companies.
  • Regulators: External dispute resolution schemes, courts, and law enforcement agencies if required by law.
  1. Giving Information is Optional
  • Providing your personal information is optional. However, if you choose not to share the information we ask for, we may be unable to provide credit, products, or services to you.
  1. Data Protection and Tracking Log
  • We maintain secure systems to protect your personal details from misuse. In line with Waka Kotahi regulations under Gazette Notice 2022-au4072, we maintain a strict log of every single query we make on the Motor Vehicle Register for a minimum of 18 months for regular audit checks.
  1. Your Rights: Access and Correction
  • You have full rights under the Privacy Act to check what personal information we hold about you. See Privacy.org.nz. You can also ask us to correct it if you find a mistake.

Complaints Process

We are committed to providing excellent customer service and are committed to resolving issues, so in the unlikely event that you have a problem understanding something or you would like to make a complaint, please let us know so that we can address it.

Who should you contact if you have a problem?

Talk to your lease consultant directly first, or contact their line manager and make them aware of your situation and the problem that has arisen so that action can be taken.

If you’re still not 100% satisfied with the outcome, or you believe that the matter is very serious, you can contact our board of directors via our Feedback & Complaints Committee at [email protected] and they will take up your concerns.

If this does not resolve your complaint fully, your next step is Financial Services Complaints Ltd (FSCL), the external dispute resolution scheme of which VFL Limited is a member. This independent body is approved by the Ministry of Consumer Affairs.
